Policies & Procedures

General Rules:

  • At any time, a Participant can be removed from all activities at Organizers discretion.
  • A driver's license and membership card with proper designations must be on your person at all times when at any S.B. work site.
  • No alcohol, firearms, or illegal substances are allowed at any S.8. work site.
  • No horseplay, groading, wrestling, boxing or any other aggressive behavior.
  • If participant's action(s) are deemed unsafe by the Organizer(s), he/she will be removed from all activities immediately, even if said Participant has not broken a specific rule.
  • Every Participant is required to wear head protection (either pot/helmet liner or hard-hat) at all times except in the loading area designated by Organizers.
  • Every Participant is required to wear steel-toe leather work-boots for foot protection. Tennis shoes are prohibited.
  • Every Participant is required to wear full length pants (jeans are highly recommended). Shorts are prohibited. If there is any question as to any rule or failure to address a situation in these guidelines, Organizers will have final determination and ruling.
  • Every Participant is required to abide by the Student Bonfire Hazing Policy at all times.

Rules for Participants in Cutting/Loading Area:

  • Any Participant who wishes to volunteer in any way at Cut Site must first satisfactory complete a Cut Safety Course offered by Organizers.
  • Participants will be put into groups designated by Organizers. Leaders of said groups will be designated by Organizers.
  • No running is allowed at cut site.
  • When handling an axe, participant should not wear a glove on the base hand.
  • Eye protection is recommended but not mandatory while felling a tree.
  • Participants are to keep all personal belongings, trees, and other debris free from obstructing travel along “tractor paths” designated by the Organizers.
  • Before felling is started, the participant shall plan and clear a retreat path.
  • An undercut and back-cut shall be made in each tree being felled so that the hinge is able to guide the tree’s fall in the intended direction. Leaders will mark all cuts before cutting begins.
  • After a tree is on the ground, “limbing” and “topping” of tree will occur by individuals designated by leaders in the given work area. “Limbing” is the act of removing the limbs from a tree to produce a usable log. “Topping” is the act of removing to upper portion of the tree once it is on the ground to produce a usable log.
  • Movement of logs will be directed by individuals whom are designated by the leader in said work area.
  • When moving a log, a path should be determined to safely move the log to a skidding area designated by Organizers.
  • Only those Participants with proper certification (designated on membership card) as a chainsaw operator may operate a chainsaw and only with the approval of the Organizers.
  • Only those participants with proper certification (designated on membership card) as a machine operator may start or operate machinery, and only with the approval of the Organizers.
  • Only those participants with proper certification by the Texas Department of Public Safety are authorized to transport materials or equipment for S.B.
  • NO hazing will be tolerated in the Cutting Area.

Rules for Participants in the Stack Area:

  • If you are not working, you must be standing outside of perimeter.
  • Never step over any ropes, walk around them. No running or horseplay.
  • Head protection (either pot/helmet line or hard-hat) must be worn at all times at stack site.
  • NO hazing will be tolerated in the Stack are.

Discipline & Review

Disciplinary action for breaking any of the above regulations will be determined by the Organizers. Such action includes, but is not limited to, the removing of Participant for a specified time, the entire day, or permanently from all Student Bonfire activities.

In general, we ask that all participants always be aware of your surroundings. The future of Bonfire depends on each Participant. Please do your part to help make Student Bonfire 2020 as safe as possible.

Hazing Policy

Student Bonfire does not tolerate hazing at any level. Below is the Texas State Hazing Law. This law defines hazing for the organization. Any member who engages in any form of hazing will be immediately terminated from the organization and will be reported to the proper authorities.

SUBCHAPTER F. HAZING

Sec. 37.151 DEFINITIONS. In this subchapter:

  1. “Educational institution” includes a public or private high school
  2. “Pledge” means any person who has been accepted by, is considering an offer of a membership from, or is in the process of qualifying for membership in an organization.
  3. “Pledging” means any action or activity related to becoming a member of an organization
  4. “Student” means any person who”
    1. Is registered in or in attendance at an educational institution;
    2. Has been accepted for admission at the educational institution where the hazing incident occurs; or
    3. Intends to attend an educational institution during any of its regular sessions after a period of scheduled vacation
  5. “Organization” means a fraternity, sorority, association, corporation, order, society, corps, club, or service, social, or similar group, whose members are primarily students.
  6. ) "Hazing" means any intentional, knowing, or reckless act, occurring on or off the campus of an educational institution, by one person alone or acting with others, directed against a student, that endangers the mental or physical health or safety of a student for the purpose of pledging, being initiated into, affiliating with, holding office in, or maintaining membership in an organization. The term includes:
    1. Any type of physical brutality, such as whipping, beating, striking, branding, electronic shocking, placing of a harmful substance on the body, or similar activity;
    2. Any type of physical activity, such as sleep deprivation, exposure to the elements, confinement in a small space, calisthenics, or other activity that subjects the student to an unreasonable risk of harm or that adversely affects the mental or physical health or safety of the student;
    3. any activity involving consumption of a food, liquid, alcoholic beverage, liquor, drug, or other substance that subjects the student to an unreasonable risk of harm or that adversely affects the mental or physical health or safety of the student;
    4. any activity that intimidates or threatens the student with ostracism, that subjects the student to extreme mental stress, shame, or humiliation, that adversely affects the mental health or dignity of the student or discourages the student from entering or remaining registered in an educational institution, or that may reasonably be expected to cause a student to leave the organization or the institution rather than submit to acts described in this subdivision; and
    5. any activity that induces, causes, or requires the student to perform a duty or task that involves a violation of the Penal Code.

Sec. 37.152. PERSONAL HAZING OFFENSE. (a) A person commits an offense if the person:

  1. engages in hazing;
  2. solicits, encourages, directs, aids, or attempts to aid another in engaging in hazing;
  3. recklessly permits hazing to occur’ or
  4. has firsthand knowledge of the planning of a specific hazing incident involving a student in an education institution, or has firsthand knowledge that a specific hazing incident has occurred, and knowingly fails to report that knowledge in writing to the dean of students or other appropriate official of the institution.
  1. the offense of failing to report is a Class B misdemeanor.
  2. any other offense under this section that does not cause serious bodily injury to another is a Class B misdemeanor.
  3. any other offense under this section that causes bodily injury to another is a Class A misdemeanor.
  4. any other offense under this section that causes death of another is a state jail felony.
  5. except if any offense causes the death of a student, in sentencing a person convicted of an offense under this section, the court may require the person to perform community service, subject to the same conditions imposed on a person placed on community supervision under Section 11, Article 42.12, Code of Criminal Procedure, for an appropriate period of time in lieu of confinement in county jail or in lieu of a part of the time the person is sentenced to confinement in county jail.

Sec. 37. 153 ORGANIZATION HAZING OFFENSE. (a) An organization commits an offense if the organization condones or encourages hazing or if an officer or any combination of members, pledges, or alumni of the organization commits or assists in the commission of hazing.

    1. An offense under this section is a misdemeanor punishable by:
      1. a fine of not less than $5,000 nor more than $10,000; or
      2. if the court finds that the offense caused personal injury, property damage, or other loss, a fine of not less than $5,000 nor more than double the amount lost or expenses incurred because of the injury, damage, or loss.

Sec. 37. 154. CONSENT NOT A DEFENSE. It is not a defense to prosecution of an offense under this subchapter that the person against whom the hazing was directed consented to or acquiesced in the hazing activity.

Sec. 37. 155. IMMUNITY FROM PROSECUTION AVAILABLE. In the prosecution of an offense under this subchapter, the court may grant immunity from prosecution for the offense to each person who is subpoenaed to testify for the prosecution and who does testify for the prosecution. Any person reporting a specific hazing incident involving a student in an education institution to the dean of students or other appropriate official of the institution is immune from civil or criminal liability that might otherwise be incurred or imposed as a result of the report. Immunity extends to participation in any judicial proceeding resulting from the report. A person reporting in bad faith or with malice is not protected by this section.

Sec. 37. 156. OFFENSES IN ADDITION TO OTHER PENAL PROVISIONS. This subchapter does not affect or repeal any penal law of this state. This subchapter does not limit or affect the right of an educational institution to enforce its own penalties against hazing.

Sec. 37. 157. REPORTING BY MEDICAL AUTHORITIES. A doctor or other medical practitioner who treats a student who may have been subjected to hazing activities:

  1. may report the suspected hazing activities to police or other law enforcement officials; and
  2. is immune from civil or other liability that might otherwise be imposed or incurred as a result of the report, unless the report is made in bad faith or with malice.

2020 Student Bonfire, Assumption of Risk

THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY.

In consideration of Student Bonfire, (hereinafter referred to as S.B.): its managers and members, landowner of property used in relation to S.B., and those persons designated by S.B. to assist in organizing, including but not limited to Directors, (Redpots) Woods Coordinators (Brownpots), and Business Coordinators (Greenpots), hereinafter referred to as Organizers, allowing the undersigned, hereinafter referred to as Participant, to engage in various physical endeavors, including but not limited to felling trees, transporting and arranging logs, and activities incidental thereto, the undersigned hereby agrees to the following:

  1. Participant recognizes and understands certain risks of harm are inherent and that there are dangers involved that cannot be fully foreseen and over which the Organizer has no control, which could result in property damage, bodily injury, or death. Student Bonfire cannot be held liable if a participant falls ill after participating in any official Student Bonfire event, i.e. cut class, cut, load, and stack.
  2. PARTICIPANT UNDERSTANDS THAT THERE ARE DANGERS AND INHERENT RISKS INVOLVED IN ANY ACTIVITY RELATED TO S.B. BUT ARE NOT LIMITED TO DEATH, SERIOUS NECK AND SPINAL INJURIES WHICH MAY RESULT IN COMPLETE OR PARTIAL PARALYSIS, BRAIN DAMAGE, SERIOUS INJURY RELATED TO THE EYE AND OR HEAD, SERIOUS INJURY TO ALL INTERNAL ORGANS, SERIOUS INJURY TO ALL BONES, JOINTS, LIGAMENTS, MUSCLES, TENDONS, AND OTHER PARTS OF THE MUSCULAR/SKELETAL SYSTEM, AND SERIOUS INJURY OR IMPAIRMENT TO OTHER ASPECTS OF HIS/HER BODY AND GENERAL HEALTH AND WELL BEING.
  3. The Organizers strongly suggest that the Participant seek medical advice prior to engaging in any part of various physical endeavors, including but not limited to felling trees, transporting, and arranging logs, and activities incidental thereto.
  4. Participant agrees to assume all risks and responsibility for any and all claims for damages, including personal injury or death, medical expenses, disability, lost wages, loss of earning capacity and property damages which may be incurred by Participant while Participant engages in various physical activities associated with SB, including but not limited to felling trees, transporting and arranging logs, and activities incidental thereto, and travel to and from said activities beginning on the date this form is authorized. IN THE EVENT OF ACCIDENTAL INJURY, THE PARTICIPANT UNDERSTANDS THAT HE/SHE IS RESPONSIBLE FOR ALL MEDICAL COSTS INCURRED FROM THE ACCIDENT
  5. Participant understands they indemnify and hold harmless the Organizers from any loss, damage, or costs, including court costs and attorney fees that he/she may incur do to his/her participation in SB., WHETHER CAUSED BY THE NEGLIGENCE OF ORGANIZERS OR OTHERWISE.
  6. I understand if I participate in inappropriate activities which violate the policies (REFER TO SAFETY REGULATIONS) of S.B. and/or municipal, state, or federal laws that I will be subject to disciplinary action by one or more Organizers and/or appropriate legal authorities.
  7. I have read the above agreement and SAFETY REGULATIONS and have willingly signed the same for the consideration expressed and with a full understanding of its purpose. Participant represents that he/she is 18 years of age or older and otherwise competent to execute this instrument, or that his/her legal guardian is also signing this agreement.

Due to the 2019-2020 outbreak of the novel Coronavirus (COVID-19), Bonfire, LLC. is taking extra precautions with the care of participants to include health history review, and enhanced sanitation/disinfecting procedures in compliance with CDC guidance. Symptoms of COVID-19 include:

  • Fatigue
  • Dry Cough
  • Difficulty Breathing

Please initial after each of the following to indicate your understanding:

  • I affirm that I, as well as all household members have not been diagnosed with COVID-19 within the past 30 days.
  • I understand the above symptoms and affirm that I, as well as all household members, do not currently have, nor have experienced the symptoms listed above within the last 14 days.

  • I understand that Bonfire, LLC. cannot be held liable for any exposure to the COVID-19 virus caused by misinformation on this form or the health history provided by each participant.
  • Bonfire, LLC. is following these enhanced procedures to prevent the spread of COVID-19:

    - Participants will remain in the designated cutting area assigned to their crew during cut.
    - Crew chiefs will sanitize and maintain tools after every use.
    - All participants will be required to bring their own independent supply of water during cut.
    - Participants will practice social distancing when at cutsite or stacksite.
  • I understand that I am required to wear a face mask covering the nose and mouth area when checking in to any Student Bonfire event, including, cut class, cut/load, and stack.
  • By signing below, I agree to each statement above and release Bonfire, LLC. from any and all liability for unintentional exposure or harm due to COVID-19.
